El encuentro de la práctica profesional con el marco deontológico-jurídico en general reviste un carácter dilemático, constituyéndose por lo tanto en una línea permanente de reflexión. Uno de los puntos a considerar en ese encuentro es la dificultad que el cruce de dis-cursos acarrea. Cada uno de estos campos, solidariamente a la lógica que los orga-niza, conlleva diferentes nociones tales como la noción de sujeto, la noción de ley, y, fundamentalmente, la noción de responsabilidad. El presente trabajo se centra fundamentalmente en el concepto de responsabilidad, con el objetivo de analizar la diferencia entre el concepto de responsabilidad jurídica y la noción de responsabilidad subjetiva. Se plantea asimismo la necesidad de reflexionar sobre los modos posibles de la articulación entre los dos niveles de la responsabilidad, y la apuesta al sujeto aún frente al campo moral. Resumen en Inglés One of the most complex issues in the Ethics of mental health related practices is the fact that this Ethics involves two differentiated fields at the same time. These fields are organized following diverse logics: on the one hand, the normative dimension, and on the other the clinical dimension. The analysis of case study vignettes about confidentiality illustrates that clinical decisions in confrontation with the juridical-deontological framework are dilemmatic for mental health professionals. In this article, the author analyses the differences between the concepts of juridical responsibility and subjective responsibility, and their implications upon the subjectiv-ity. The author also presents some considerations regarding the ethical position of the professional in mental health, facing the confrontation between the normative field and the clinical dimension.
