Este trabajo tiene como objetivo analizar los Proyectos de Ley existentes para modificar la Ley de Minoridad de la Provincia de Buenos Aires. A partir de la introducción de la Convención Internacional de los Derechos del Niño en nuestra Constitución Nacional, se muestra como necesaria la modificación de la Ley 10.067 del Patronato de Menores que rige actualmente en nuestra provincia. A partir de la necesidad de modificación de la Ley han surgido dos proyectos de Ley. La 12.607 sancionada en el año 2000, y el Proyecto de Ley Corvatta presentado en al año 2003, presentan diferencias tanto en su contenido como entre quienes la apoyan y la resisten, manifestando dos concepciones contrapuestas sobre la infancia. Analizaremos el Proyecto de “Ley del niño y el joven” (Corvatta) a partir de tres Jornadas de debate desarrolladas en la ciudad de La Plata en el año 2003, con miembros del Poder Judicial, funcionarios de los municipios bonaerenses y representantes de ONGs dedicadas a la infancia. Por otra parte, intentaremos hacer un contrapunto con la Ley 12.607, en las temáticas referidas al Paradigma de Protección Integral y a la noción del Interés Superior del Niño. Resumen en Inglés The purpose of the present work is to analyze the present bills that try to modify the current Minority Law of Buenos Aires Province. Since the Convention on the Rights of the Child became part of the National Constitution, there has been a need to modify the 10.067 Law, “Patronato de menores,” that is in force in the province at present. From the need to modify this law, two bills have emerged. The 12607 law, sanctioned in 2000, and the Corvatta´s bill submitted in 2003. These bills present differences both in their content and as regards who supports or is against each of them, expressing contrasting ways of understanding childhood. We’ll analyze Corvatta´s bill named “Youth and children’s law,” taking as a starting point the three-day discussion expounded in La Plata City in 2003 involving members of the Judiciary and the town council, and members of NGOs working with childhood. Moreover, we’ll contrast this bill with the 12607 Law in the topics concerning the Paradigm of Integral Protection and the notion of Superior Interest on the child. Palabras Clave emergencia niño
