El propósito de este trabajo es mostrar el entrecruzamiento de discursos que se dan cita en la mediación. Aún cuando esta nueva práctica se ha instalado en nuestro medio desde el discurso jurídico, la psicología y el psicoanálisis no sólo aportan conceptos fundamentales a la constitución de este nuevo campo, sino también pueden reclamar su inserción a nivel del ejercicio de la práctica. Intentaremos dar cuenta de las afirmaciones analizando las relaciones entre la mediación y el discurso jurídico, definiendo el campo de trabajo y los objetivos de la mediación e identificando las contribuciones del campo psi, para reconocer este atravesamiento discursivo y para iniciar un debate sobre las incumbencias profesionales. Resumen en Inglés The purpose of this paper is to show the different discourses that meet in the core of mediation. Even though this new practice has been brought about in our country related to the legal speech, psychology and psychoanalysis not only provide ground concepts for the constitution of this discipline, they can even demand their incorporation into the actual practice. We will try to justify our assertions through the analysis of the links between mediation and law, the definition of the working field and mediation’s aims, and the identification of the psychological and psychoanalytical contributions, in order to acknowledge the interrelations inside mediation and to start a debate about professional jurisdictions.
