A finales del siglo XIX y principios del XX el panorama de las ideas en la Argentina recibe la decidida impronta del pensamiento positivista (Biaggni, 1985) lo cual provoca manifestaciones concretas en la forma de concebir al sujeto involucrado en las producciones sobre criminiloga, psiquiatra y medicina legal - para mencionar solo aquellas reas que hacen al tema de nuestro trabajo. En lo que sigue, me propongo analizar la nociones de sujeto implicadas en el discurso de la poca, abordando las nociones de “crimen”, “criminal” y “delincuente” que se sostena, el correlato de “culpa” o “responsabilidad” que se le adjudicaba, para evidenciar all el sustrato moral que supone un hecho alejado de la norma y por ello antisocial. Para tal fin abordar algunos segmentos de la obra de Ingenieros y la crtica que le realiza Alberini a fin de explicitar el contrapunto existente en las nociones de determinismo y libertad, moralidad y amoralidad, tal como lo plantean respectivamente. Palabras clave Moralidad positivismo Argentina ABSTRACT THE PLACE OF MORALITY IN THE ARGENTINE POSITIVISM: ISSUES ABOUT THE BLAME, RESPONSIBILITY, FREEDOM AND DETERMINISM At the end of the 19th century and at the beginning of the 20th century, the outlook of the ideas in Argentina recieves the determined impression of the positive thought (Biaggni, 1985) which produces concrete manifestations in the way of conceiving the person involved in the productions about Criminology, Psychiatry and Legal Medicine - just to mention only those subjects that are involved in our task. So, I intend to analyse the ideas of the person involved in the speech of the time, discussing the notions about “crime”, “criminal” and “offender” that were maintained, the correlative statement of “guilt” or “responsibility” which were conferred, in order to show there the moral substratum that involves a fact far from the norm and so, antisocial. Therefore, I will take some parts of the works of Ingenieros and the criticism made by Alberini in order to make it clear the difference that exists in the concepts of determinism and freedom, morality and amorality, as they are respectively approached-posed.
