A partir de agosto de 2015 entró en vigencia el nuevo Código Civil y Comercial argentino. Las modificaciones introducidas buscaron adecuar la normativa local a los máximos estándares internacionales en materia de Derechos Humanos. En el marco del proyecto de investigación que nos ocupa (López, 2013) uno de los objetivos es relevar las cuestiones éticas en la práctica psicoanalítica originadas en el cruce con diversos discursos institucionales, entre ellos, las normativas vigentes. A partir de la revisión y actualización bibliográfica, hemos indagado sobre la nueva concepción del derecho a la salud para el caso particular de los jóvenes a partir de los 13 años que se desprende del artículo 26° del CCyC. A la vez, hemos intentado analizar su impacto en la práctica psicológica y psicoanalítica, relevando posibles problemas éticos en torno de las cuestiones relativas a la autonomía y confidencialidad, así como a la pauta de consentimiento informado. Es que la nueva norma introduce una suerte de “mayoría de edad anticipada” para este grupo etáreo respecto de su derecho a decidir acerca de tratamientos sobre su propio cuerpo. Concluimos que tales modificaciones deben ser incorporadas en el debate profesional, ya que se advierten potenciales dilemas éticos. Palabras clave Adolescentes, Derechos, Salud, Ética ABSTRACT THE ADOLESCENTS AND THEIR RIGHT TO HEALTH ACCORDING TO THE NEW CIVIL AND COMERCIAL NATIONAL CODE: ETHICAL IMPLICATIONS TO THE PSYCHOLOGICAL AND PSYCHOANALITICAL PRACTICE Since the August 1st, 2015 there is a new Civil and Commercial Argentine Code. The modifications sought to adapt the local law to the international regulations about Human Rights. As part of our research project (López, 2013), one of the aims is to investigate the ethical questions that arouse in the psychoanalytic practice and its crossing with diverse institutional discourses, including, the actual regulations. On this occasion, through a bibliographical update, we have investigated on the new concept of the right to health in the particular case of adolescents from 13 years of age, according to the article 26° of the new code. In addition, we have tried to analyze its impact on the psychological and psychoanalytical practice by compiling possible ethical problems as regards autonomy, confidentiality and the guideline of informed consent. The new norm – according to the protected rights of children and adolescentsintroduces a distinction for this group about their right to decide about medical treatments on their own body. Our conclusion is that such modifications must be incorporated in the professional debate, since various possible ethical dilemmas have been identified as a result of the new concepts.
